1. INTRODUCTIONAND INCORPORATION OF TERMS
1.1 TheseRegulations set out the rules and regulations for the staging of theChampionship and apply to each Participant.
1.2 TheChampionship is staged on the Platform, and accordingly the OfficialSporting Code of the Platform (the “Sporting Code”), Terms of Use and End User LicenceAgreement of the Platform and BroadcastPolicy of the Platform (together the “Platform Documents”)are incorporated into these Regulations and apply to each Participant.
1.3 Inthe event of a conflict between these Regulations and any of the PlatformDocuments, these Regulations shall take priority.
1.4 Pleasenote that in respect of the processing of personal data in connection with the Championship:
1.4.1 thePrivacy Policy of the Platform describes how personal data iscollected and processed on the Platform;
1.4.2 thePrivacy Policy of the SimGrid Website describes how personal data iscollected and processed on the SimGrid Website; and
1.4.3 theChampionship Privacy Policy describes how personal data iscollected and processed by the Organiser and Porsche in connection with theoperation of the Championship.
1.5 Byparticipating in the Championship, each Participant agrees to comply at alltimes with Porsche’s Code of Conduct for Business Partners.
2. ORGANISATIONOF THE CHAMPIONSHIP
2.1 TheChampionship consists of five Championship Events, with each Championship Eventconsisting of one Qualifying Session and two Races, as further detailed inRegulations 5 and 6. The Championship shall have two separate Classifications,the professional Classification and the amateur Classification.
2.2 Thedates and virtual circuits for each Championship Event are as follows:

2.3 TheOrganiser reserves the right to cancel or relocate a Championship Event orindividual Events without any liability to any Participant.
2.4 TheOrganiser is solely responsible for all aspects of the staging and operation ofthe Championship and all questions and queries regarding the Championshipshould be directed to the Organiser at: [email protected].Accordingly, each Participant acknowledges and agrees that:
2.4.1 Porscheshall have no liability in respect of the Championship and its operation (savefor any breach by Porsche of the licence set out in Regulation 10.3);
2.4.2 eachParticipant’s sole recourse in respect of any matter arising out of or relatingto the Championship and these Regulations (save for any breach by Porsche ofthe licence set out in Regulation 10.3) shall be to the Operator; and
2.4.3 nothingin this Regulation 2.4 shall affect Porsche’s ability to rely on the licenceset out in Regulation 10.3.
3. REGISTRATION
Registration Process – ChampionshipEvents
3.1 Inorder to participate in the Championship Events a Driver must:
3.1.1 bea legal resident of the United Kingdom;
3.1.2 beat least 18 years of age;
3.1.3 nothave ever competed in either the Porsche TAG Heuer Esports Supercup or PorscheEsports Carrera Cup GB;
3.1.4 ownat the time of registration and continue to own throughout the Championship, aMotorsport UK Esports paid membership (£24.99 for a 12-month membership);
3.1.5 completeand sign the Application for Driver Entry (on behalf of themselves and anyother members of their team) and submit it to the Organiser at [email protected] or before 23.59 on Friday 30th August 2024 (or, in respect ofWaiting List Drivers and Guest Drivers, such time and date as is notified bythe Organiser to the applicable Waiting List Driver or Guest Driver);
3.1.6 completethe ‘Register’ process for the Championship on the SimGrid Website. Thisincludes choosing either the professional or amateur Classification in accordancewith Regulation 6.1;
3.1.7 ensurethat the Application for Driver Entry is provided complete with full car designand livery specifications, designed within the Platform and compliant withRegulation 10.1, as a vector file (.eps or .ai);
3.1.8 haveregistered an account on the Platform (and include their Platform ID withintheir Application for Driver Entry);
3.1.9 nothave an iRacing licence lower than Class D 2.0;
3.1.10 notbe persons designated by OFAC as Specially Designated Nationals; and
3.1.11 havebeen invited to particate in the Championship Event under Regulation 3.2.
3.2 AnApplication for Driver Entry shall be determined by the Organiser in its solediscretion and the Organiser will provide a confirmation email to any personwhose Application for Driver Entry is successful and who is accordingly invitedto participate in the Championship Events. Each Championship Event will haveup-to twenty (20) Registered Drivers (for the avoidance of doubt, this is twenty(20) Registered Drivers in each of the professional and amateur Classifications).
3.3 Pleasenote that the Organiser reserves the right to invite Guest Drivers to any ofthe Races or Events that take place during the Championship.
Entry fees for the Championship
3.4 Therewill be no registration/entry fees for Participants for competing in theChampionship, but, as per Regulation 3.1.3, all Registered Drivers are requiredto have a paid Motorsport UK Esports membership.
Social Media Guidelines
3.5 Anycommunications posted on Social Media Platforms in relation to theChampionship, must at all times comply in full with the Social Media Policy.
4. OPERATIONOF EVENTS – GENERAL
4.1 League
Each Championship Event shall bestaged as a ‘Hosted Session’ (“Session”) within the Platform with theoverall Championship taking the form of a league. All Registered Drivers shallreceive invites to join Sessions and/or the league.
4.2 Conductof Races
Each Race shall be conducted inaccordance with, and shall be subject to the rules of, the Sporting Code andthe Motorsport UK Race with Respect Code of Conduct
4.3 Racetiming and weather
All Races will be staged usingautomatically ‘forecasted’ weather and dynamic sky. The date will be set to thedate of the Race plus six months, while the time of day will be set as follows:
Race 1: 10:00am
Race 2: 3:00pm
4.4 Setup
All cars inthe professional and amateur Classification will have fixed setups. All Drivers will be provided the fixed set up (aswell as confirmation of any adjustable settings) reasonably in advance of aChampionship Event.
5. OPERATIONOF EVENTS – QUALIFYING SESSION
5.1 General
5.1.1 TheQualifying Session for each Championship Event shall take place before thefirst Race of a Championship Event. The Qualifying Session shall consist of onelone Session of 10 minutes in duration, whereby the Driver shall have 10minutes to set a qualifying time over a maximum of three laps.
5.1.2 EachQualifying Session shall have a maximum of 20 Drivers in each Classification,.
5.1.3 Thequalifying time from the Qualifying Session shall determine the grid order forthe first Race of a Championship Event. For the second Race of each ChampionshipEvent the grid positions will be determined by the finishing grid order of thefirst Race of the Championship Event. For example, if a Registered Driverfinishes third in the first Race, he shall start the grid from third position forthe second Race.
6. OPERATIONOF EVENTS – CHAMPIONSHIP EVENTS
6.1 Commitmentto participate
6.1.1 EachRegistered Driver shall use all reasonable endeavours to fully participate ineach Championship Event.
6.1.2 Ifa Registered Driver is unable to participate in a Championship Event for anyreason then they must (where it is possible to do so) withdraw from theChampionship Event on the SimGrid Website. In such circumstances the applicableRegistered Driver may be replaced by a Guest Driver (at the discretion of theOrganiser).
6.1.3 Pleasenote that Regulation 8.3.2 shall apply where a Qualifying Driver is unable or doesnot participate in two or more Championship Events.
6.2 Classifications
A Driver will be classified in the professional Classificationif, on the day of registering, they have ever reachedan iRating on iRacing of 3,000 or more. If a Driver has never reached aniRating on iRacing of 3,000 or more, they shall be classified as an amateur.
6.3 Starttimes
All Championship Events are held on a Tuesdayand will start at 18:00 UK time.
6.4 Championshipnumbers
Each RegisteredDriver participating in the Championship Events will choose an available Championshipnumber when registering on the SimGrid Website, which will apply for all ChampionshipEvents. Where a Driver has requested that they be allocated a specificChampionship number in their Application for Driver Entry, the Organiser shallconsider such request but shall ultimately determine the number to be allocatedin its sole discretion. Each Registered Driver is responsible for the proper configuratingof their Championship number within the Platform prior to the start of thefirst Championship Event in which they participate. Registered Drivers will alsobe assigned start numbers for each Championship Event.
6.5 Minimumand maximum number of cars
EachChampionship Event shall feature a maximum of 20 cars (with the 20 cars beingCup cars for the professional Classification and GT4 cars for the amateur Classification).
6.6 EventSettings
Every ChampionshipEvent’s free practice Sessions will be staged using the same in-game date andtime of day as the Race Session.
6.7 FreePractice Session
There will bea four-hour free practice Session on two days prior to the Race day – on the Saturday and Monday from 18:00 to 22:00 UK time. Registered Drivers are allowed toenter and exit the pitlane as they please or jump directly to the pits whenstopping safely on track.
6.8 Qualification
The QualifyingSession for each Championship Event, to determine the starting positions ofeach Qualifying Driver in Race 1, will last for 10 minutes and a maximum of twolaps. The Session will be set to lone-qualifying. Qualifying Drivers areallowed to enter and exit the pitlane as they please or jump directly to the pitswhen stopping safely on track.
6.9 Races
6.9.1 EachChampionship Event will consist of two Races. Each Race is time-based and setto a duration of 40 minutes. Drivers will be shown the white flag at the startof their last lap, once the Race leader has crossed the line with insufficienttime remaining to complete more than one lap before the time expires.

(a) Championship Points awardedfor finishing order in Race 1.
(b) Race 1’s finishing order willdetermine starting order of Race 2.
Race 2:
(a) Grid determined by finishingorder from Race 1.
(b) Champions Points awarded forfinishing order in Race 2.
6.10 EventTimetable.
The followingtable shows the typical timetable for each Championship Event (with both Classificationstaking place simultaneously). All times are UK time. The Organiser will notifyall Registered Drivers by email and/or Discord if there is a material change toany of the timings set out below.

7. SETUPAND TYRES
7.1 Tyres
7.1.1 EachRegistered Driver will have an unlimited number of tyres for each ChampionshipEvent.
7.1.2 Inrespect of free practice and Qualifying Sessions, Registered Drivers will beable to leave the pits with a fresh set of tyres and an undamaged car everytime they leave the pitlane.
7.1.3 Inrespect of Races, each Registered Driver will start each Race with a fresh setof tyres and may elect to change their tyres, refuel and/or repair the carduring a Race (but the car will not, unless it is repaired, leave the pitlanewith any damage sustained prior to the pitstop having been repaired). In both Classifications,all Drivers will be allocated one fast repair to use during each Race.
8. AWARDINGOF POINTS AND PRIZES
8.1 Thewinner
The winner ofeach Race is the Driver who is in first position at the end of the Race (onceit is completed in accordance with Regulation 6.9.1), taking account of all penalties.
8.2 Tableof points: Overall Classification
Championship Pointswill be awarded for the position of each Registered Driver (taking account ofany penalties incurred) at the end of each Race as follows:

So, forexample, a Registered Driver who finished first in Race 1 and third in Race 2 (subjectto any penalties) in a particular Championship Event would receive a total of42 Championship Points for such Championship Event .
Additionally,one Championship Point is awarded to each Registered Driver who sets thefastest lap time in each of Race 1 and Race2, respectively and two Championship Points are awarded to the RegisteredDriver who sets the fastest lap time in the Qualifying Session (meaning anadditional four Championship Points in total are available during eachChampionship Event).
8.3 DriverClassification
8.3.1 Allresults of the individual Championship Events count towards the OverallClassification, and there are no void or ‘dropped’ results. The Overall Classificationis listed separately from the classification of each Race and represents theaggregate of all Championship Points awarded to each Registered Driver over thecourse of the entire Championship. The winner of the Championship is the RegisteredDriver with the highest number of Championship Points in the OverallClassification after the completion of the final Championship Event.
8.3.2 TheRegistered Driver named in the Application for Driver Entry must take part in asingle Championship Events in order to be included in the final OverallClassification for the Championship.
8.4 Overallwinner
The winner ofthe Championship is the Registered Driver with the highest number of ChampionshipPoints in each Classification after the completion of the final ChampionshipEvent and they will be awarded the title: “Porsche Esports Sprint Challenge GBChampion 2024”.
8.5 Prizes

9. JUDICIALPROCEDURES AND PENALTIES
9.1 RaceReview
9.1.1 AllRace results are preliminary until the Stewards have reviewed the Race start(s)and all protested incidents. Following this review, the Stewards will apply penalties,when appropriate, and will accordingly adjust the Race result if applicable.
9.1.2 Stewardsmay award warnings, time penalties, qualifying bans (meaning that theapplicable Qualifying Driver must start a Race at the back of the grid) as wellas disqualifications and exclusions from future Championship Events (or fromthe Championship altogether).
9.1.3 TheStewards have absolute discretion to issue penalties according to the severityof the incident in question and, in respect of time penalties, the list offurther sanctions set out in Regulation 9.5 shall also apply.
9.2 IncidentPoints
9.2.1 EveryRace will utilise the Platform’s incident monitor, and will impose an Incident PointLimit to monitor track limits as well as driving standards in general. If a RegisteredDriver incurs more than 20 Incident Points in all Races in any singleChampionship Event this will result in an automatic drive through penalty. Adrive through penalty will also be incurred every 10 Incident Points after thefirst drive through penalty.
9.3 Protests
9.3.1 AnyDriver that is involved in or affected by an incident that occurs during anEvent may file a protest to the Stewards using the Protest Form. Every protestmust be submitted via the Protest Form and must include the car number of theprotesting Driver, the car number of the Driver (or Drivers) in respect of whomthe protest is being made, the Session and (in the case of a Race) lap in whichthe incident occurred as well as a brief description of the incident itself.
9.3.2 Thedeadline to submit protests is 21:30 UK time on the date of the applicable incident(the “Protest Submission Deadline”).
9.3.3 Byparticipating in the Championship, every Participant agrees to accept thedecisions of the Stewards, which are final. In particular, there is no form ofappeal to Porsche or any other body.
9.4 IncidentSummary Report
9.4.1 Afterbeing reviewed by the Stewards, the outcomes of all protests, potentialpenalties as well as the official Race results will be published in the form ofan incident summary report. This report will be published no later than 24hours after the Protest Submission Deadline.
9.4.2 Allprotest outcomes published in the incident summary report are final and may notbe appealed.
9.5 PenaltySystem
9.5.1 Inaddition to their ability to issue a qualifying ban and/or disqualify Drivers,the following penalties may be used by the Stewards depending on the severityof the incident:
(a) warning;
(b) 5 second time penalty added toRace time;
(c) 10 second time penalty addedto Race time;
(d) 15 second time penalty addedto Race time;
(e) 20 second time penalty addedto Race time;
(f) 25 second time penalty addedto Race time; or
(g) 30 second time penalty addedto Race time;
9.5.2 Inaddition to the time penalties set out in Regulation 9.5.1 that will apply to a single Race, all time penalties aretracked over the course of the Championship and additional sanctions may beimposed where a Registered Driver’s cumulative time penalties over the courseof the Championship (including all Events) meet or exceed certain thresholds,as follows:

For the purposes of this accumulatedpenalty time, every second warning issued by the Stewards will also result in afurther five second penalty being added to the accumulated penalty time. Shoulda Qualifying Driver surpass multiple thresholds during a single ChampionshipEvent, only the more severe penalty will apply. Note that only warnings andtime penalties given by the Stewards will count towards the accumulated penaltytime, and any time penalties given for exceeding the Incident Point Limit willnot.
10. COMMERCIALPROVISIONS
10.1 CarLivery
10.1.1 RegisteredDrivers must submit their own liveries for their cars (“Liveries”) tothe Organiser via the Livery Upload Folder in the Motorsport UK Esports Discordon or before 11:59pm GMT Friday 6th September 2024 (the “LiveryDeadline”). The Organiser provides no guarantee that any Livery submittedafter the Livery Deadline shall be considered for inclusion in theChampionship. AnyDriver who submits their Livery late or in a manner that is not compliant withthese Regulations may be required by the Organiser to use a car that includesno branding other than that provided by the Organiser.
10.1.2 ALivery must comply with the following principles (and any further principlesset out in the Application for Driver Entry):
(a) the official Championshiplivery decal layer will be applied to all competing cars. Therefore, no logosor branding should clash with the decal layer. The decal layer can be found inthe Motorsport UK Esports Discord server;
(b) the Registered Driver musthave written permission from the property owner for use in the Championship of anylogo or copyrighted material on a Livery;
(c) all Liveries used must adhereto the iRacing Paint Policy found here (https://bit.ly/iracing-paint-policy); and
(d) any political, offensive,defamatory, harmful or otherwise indecent material on a custom Livery will resultin the Registered Driver being banned from the Championship.
10.2 PromotionalObligations
10.2.1 EachDriver shall participate in such promotional obligations relating to theChampionship as reasonably requested by the Organiser from time to time.
10.2.2 EachDriver may (and is encouraged to) promote their involvement in the Championshipon social media, provided that all such posts comply with the Social MediaGuidelines. Promotional images may be shared on Discordas notified by Organiser.
10.3 Grantof licence
10.3.1 EachParticipant grants to the Organiser and Porsche a worldwide, irrevocable,perpetual, sub-licensable, transferable, royalty-free right and licence to use:
(a) such Participant’s name,nickname, image, likeness, biography, signature, voice and film andphotographic portrayal, virtual and/or electronic representation, reputation,replica, relevant racing statistics and all other characteristics andattributes of the Participant;
(b) in the case of Drivers, theLivery provided by them for use in the Championship (and any logos, trademarks, service marks (including of sponsors) or other material incorporated insuch Livery); and
(c) any audio, visual oraudio-visual materials produced during or after the Championship that featurethe Participant and/or any of the materials listed above in this Regulation 10.3.1,
in each case for the followingpurposes.
(d) in connection with thetransmission (via any medium) of coverage of the Championship;
(e) in advertising and promotionalmaterial for Porsche, the Championship, the real-world Porsche Sprint ChallengeGB (the “RW Championship”) or future championships operated inassociation with the Porsche brand (such as television promotions, posters andadvertising);
(f) in advertising and promotionalmaterial produced by or on behalf of the commercial partners of theChampionship and/or Porsche, the RW Championship and/or future championships operatedin association with the Porsche brand from time to time (such as printadvertising, outdoor advertising, point of sale advertising, trade-on-tradepromotions, programming and website material) to promote their association withthe Championship, Porsche, the RW Championship and/or future championshipsadministered by Porsche, in each case provided always that no such use shallsuggest individual endorsement by that Participant of the products or servicesof any of such commercial partners;
(g) on merchandising or othermarketing material relating to the Championship or future championshipsadministered by Porsche; and
(h) in connection with (andincluding within) interactive computer games and/or video games (including forthe purposes of esports activities in any media).
10.3.2 Forthe avoidance of doubt, the licence granted in Regulation 10.3.1 shall survive the termination or expiry of therelevant Participant’s participation in the Championship.
10.3.3 EachParticipant hereby represents and warrants that:
(a) the exercise of the rightsunder Regulation 10.3.1 by the Organiser and/or Porsche(and any other third parties that the Organiser and/or Porsche licenses suchrights to) shall not infringe the rights, including the intellectual propertyrights, of any third party; and
(b) it has all rights, licencesand permissions necessary from the relevant third parties in order to grant therights set out in Regulation 10.3.1.
11. GOVERNINGLAW AND DISPUTES
11.1 TheseRegulations shall be governed by and construed in accordance with English law.
11.2 Anydispute arising out of or in connection with these Regulations shall be referredto Sport Resolutions (UK) (a trading name of The Sports Dispute ResolutionPanel Ltd – Company No. 3351039) for final and binding arbitration inaccordance with the Arbitration Act 1996 and Sport Resolutions (UK)’sArbitration Rules, which Rules are deemed to be incorporated by reference tothis Regulation 11.
12.
APPENDIX 1 – DEFINITIONS AND INTERPRETATION
1. Thefollowing terms shall have the following meanings when used in theseRegulations:
“Application for Driver Entry” the applicationform for entry into the Championship provided by the Organiser;
“Championship” means the Porsche Esports Sprint ChallengeGB 2024;
“Championship Event” means each round of theChampionship consisting of one Qualifying Session and two Races, the format ofwhich is set out in Regulation 6.10;
“Championship Points” means points allocateddepending on a Qualifying Driver’s finishing position at the end of a Race, asfurther detailed in Regulation 8.2;
“Classification” means, as the context requires, theprofessional classification and/or the amateur classification;
“Discord” means the MotorsportUK Esports server on the Discord platform;
“Driver” means any person who competes in theChampionship from time to time as a driver of a sim-racing car;
“Event” means, as the context requires, a QualifyingSession and/or a Race;
“Guest Driver” means any Driver who is invited bythe Organiser to participate in the Championship (or any Championship Event)without having applied through an application for Driver Entry;
“Incident Points” means the system within thePlatform that identifies incidents of poor or dangerous driving and allocatespenalties accordingly;
“Incident Point Limit” has the meaning given inRegulation 9.2.1;
“Livery” has the meaning given in Regulation 10.1.1;
“Livery Deadline” has the meaning given inRegulation 10.1.1;
“Organiser” Motorsport UK Association Limited;
“Overall Classification” means, in relation toeach Classification, the overall Championship Points standings for theChampionship in aggregate across all Championship Events;
“Participant” means any Driver and any member oftheir support team, as detailed on the Application for Driver Entry;
“Platform” means the iRacing sim-racing platform;
“Platform Documents” has the meaning given inRegulation 1.2;
“Protest Form” means the protest form availablefrom the Organiser on request;
“Porsche” means Porsche Cars Great Britain Ltd, acompany registered in England with its registered address at Bath Road, Calcot,Reading, Berkshire RG31 7SE (and any other affiliates of Porsche Cars GreatBritain Ltd and/or members of its group of companies);
“Protest Submission Deadline” has the meaninggiven in Regulation 9.3.2;
"Qualifying Session” means the qualifyingsession to determine the starting grid order for the first Race of eachChampionship Event, which shall take place before the first Race of theChampionship Event;
“Registered Driver” means a Driver who has beeninvited by Porsche to participate in the Championship and subsequentlyregisters for the Championship on the SimGrid Website;
“Regulations” means these rules and regulationsfor the Championship, including the Appendices;
"Race” means a race which forms part of aChampionship Event;
“RW Championship” has the meaning given inRegulation 10.3.1(e);
“Session” has the meaning given in Regulation 4.1;
"SimGrid Website” means the followingwebsite: https://www.thesimgrid.com/;
"Social MediaPlatform" means any form of social media, including for example Facebook,X (Twitter), Instagram, LinkedIn, Weibo, internet postings, blogs, Snapchat andchat rooms;
“Social Media Policy” means the social mediapolicy contained at Appendix 2 of these Regulations;
“Steward” means an official steward of theChampionship and/or a Championship Event, as appointed by the Organiser fromtime to time in its sole discretion;
“Waiting List” means the waiting list of driverswho were unsuccessful in their application to participate in the Championship butwho were selected to be on a waiting list of Waiting List Drivers; and
“Waiting List Driver” means a Driver who isinvited by the Organiser to participate in the Championship having been on theWaiting List.
2. Thefollowing rules of interpretation apply to these Regulations:
2.1 any obligations imposed on a "Driver" in these Regulationsinclude an obligation on that Driver to procure such obligation is compliedwith by any employees (direct or indirect), consultants, agents, team membersor third parties acting on that Driver’s behalf (including any otherParticipants named on such Driver’s Application for Driver Entry), and thatDriver shall be primarily liable for any breach of any of these Regulations byany of the foregoing;
2.2 use of the singular includes the plural andvice versa and words importing any particular gender shall include all othergenders;
2.3 any reference to a statute, statutoryprovision, subordinate legislation, code or guideline ("legislation") is a reference tosuch legislation as amended and in force from time to time and to anylegislation that re-enacts or consolidates (with or without modification) anysuch legislation;
2.4 any reference to a document, agreement,regulation, code or equivalent shall be to that document, agreement,regulation, code or equivalent as amended, varied or restated from time totime;
2.5 any phrase introduced by the terms "including", "include", "such as" "in particular" or any similarexpression shall be construed as illustrative and shall not limit the sense ofthe words preceding those terms;
2.6 in writing includes by email unless otherwiseindicated; and
2.7 the Appendices form part of these Regulationsand shall have effect as if set out in full in the body of these Regulationsand any reference to these Regulations includes the Appendices.
3. Anynotice to be provided to a Participant in writing shall be sent by email to theemail address for that Participant set out on the Application for Driver Entry.Any such email shall be deemed delivered on the date and at the time it issent.
4. Anyreferences in these Regulations to consent or approval to be given by the Organisershall be determined by the Organiser in its absolute and sole discretion and nodecision shall be considered to be setting a precedent for any future decisionof the Organiser.
5. (a)If any provision of these Regulations shall be found by any court oradministrative body of competent jurisdiction to be invalid or unenforceable,such invalidity or unenforceability shall not affect the other provisions ofthese Regulations, which shall remain in full force and effect. (b) If any provision of these Regulations is so found to be invalid orunenforceable but would be valid or enforceable if some part of the provisionwere deleted, the provision in question shall apply with such deletion(s) asmay be necessary to make it valid. (c)In the circumstances referred to in paragraph (a) and if paragraph (b) does notapply, the Organiser shall attempt in good faith to substitute for any invalidor unenforceable provision a valid or enforceable provision that achieves tothe greatest extent possible the same effect as would have been achieved by theinvalid or unenforceable provision.
APPENDIX 2 – SOCIAL MEDIA POLICY
Porsche acknowledges that social mediais an important form of communication for many Participants and provides anexcellent opportunity to engage with fans. Use of social media can, however, also create risk to the reputation of Participants,Porsche, the Championship, the RW Championship and the Organiser. In addition, use of social media also canrisk the confidentiality of information. Therefore, in addition to theobligations set out elsewhere in these Regulations, Porsche requires each Participantto abide by this Social Media Policy in all uses of any Social Media Platformto ensure the appropriate, responsible and professional use of social media inrelation to the Championship and the RW Championship.
1. This policy applies to the use of all SocialMedia Platforms by Participants and any person or entity acting on their behalf(including employees (direct or indirect), directors, consultants, mechanics,agents or other third parties).
2. To the extent Porsche has an officialChampionship or RW Championship account on a Social Media Platform, Porscheencourages each Participant to link its/their account on that Social MediaPlatform to such official account.
3. Each Participant represents, warrants andundertakes that:
(a) he/it will not use any Social Media Platformin a way that:
(i) breaches any obligations of confidentialityowed to Porsche, the Porsche group, the Organiser, any Steward or any other Participantor any of the foregoing's employees (direct or indirect), directors,consultants, mechanics or agents (the "Stakeholders" and each, a "Stakeholder");
(ii) breaches these Regulations or any regulationsapplicable to the RW Championship (the “RW Championship Regulations”);
(iii) is likely to bring any Stakeholder intodisrepute;
(iv) is likely to cause any Stakeholder to breachthese Regulations or the RW Championship Regulations;
(v) is likely to cause damage to the reputationof any Stakeholder;
(vi) is likely to cause financial liability to anyStakeholder;
(vii) unlawfully discriminates against, harasses orvictimises any third party, or is defamatory, obscene or offensive;
(viii) (unless expressly authorised in advance inwriting by Porsche) implies that it/he is representing the views of Porsche;and/or
(ix) criticises, questions or denigrates anydecision made by a Steward or the performance of any other Participant;
(b) it/he will not post or otherwise communicateany audio, visual or audio-visual content related to the Championship or the RWChampionship, save as permitted in these Regulations;
(c) when using any Social Media Platform, it/hewill have regard at all times to the requirement to project a positive image ofthe Championship, the RW Championship and Porsche; and
(d) it/he will comply with the reasonableinstructions of Porsche and the Organiser regarding the use of any Social MediaPlatform in relation to the Championship (including, without limitation, anyinstructions to amend and/or remove any communication or similar).
4. In addition to any other remedies for breachof the Regulations, Porsche and/or the Organiser may require the Participant toamend and/or remove any communication or similar that is in breach of thisSocial Media Policy.
